Welcome to Bitfun. These Terms of Use ("Terms") govern your access to and use of the Bitfun website located at bitfun.ai (the "Site") and the Bitfun mobile application (the "App"), collectively referred to as the "Service". The Service is operated by Bitfun ("we", "us", or "our").

Important Notice: This Site is primarily intended for informational purposes and to provide updates via our newsletter. The actual registration for and use of our automated trading and DCA services are provided exclusively through the Bitfun mobile application available on Android and iOS platforms. By accessing this Site or downloading the App, you agree to be bound by these Terms.

2. Description of Service

Bitfun provides a technical platform that allows users to automate their cryptocurrency trading strategies, specifically focusing on Dollar-Cost Averaging (DCA) and other algorithmic methods. Our Service acts as a bridge between your chosen cryptocurrency exchange and your trading strategy.

Bitfun is not an exchange, a broker-dealer, or a financial advisor. We do not provide investment advice, and we do not execute trades directly on our own books. Instead, we transmit your instructions to your connected exchange via Application Programming Interface (API) keys that you provide.

• Non-Custodial Service: Bitfun does not hold, manage, or take custody of your funds. All assets remain in your personal exchange account at all times.
• API Connectivity: You are responsible for generating and providing API keys from your exchange. We strongly mandate that you disable "Withdrawal" permissions for any API keys used with Bitfun.
• Execution: While Bitfun strives for high availability, we do not guarantee that all trade instructions will be executed by your exchange due to factors beyond our control, such as exchange downtime or network latency.

3. Eligibility and Account Registration

To use the App and certain features of the Site, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. You represent and warrant that you are not a citizen or resident of any jurisdiction where the use of our Service would be illegal or require registration that we do not have.

Account creation is handled exclusively through the App. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your account credentials and for any activities or actions under your account.

4. User Obligations and Restrictions

By using Bitfun, you agree to the following:

• You will not use the Service for any illegal purpose or in violation of any local, state, national, or international law.
• You will not violate or encourage others to violate the rights of third parties, including intellectual property rights.
• You will not attempt to interfere with the proper working of the Service, including bypassing any security measures or reverse engineering the App.
• You acknowledge that you are solely responsible for the tax implications of your trading activities.

5. Risk Disclosure and Financial Disclaimer

Performance Disclaimer: Past performance of any trading strategy is not indicative of future results. Automated trading systems can fail due to technical issues, market conditions, or incorrect configuration. You assume all risks associated with the use of automated strategies.

6. Fees and Payments

Bitfun may charge fees for the use of certain features in the App. Detailed information about our pricing structure is available within the App. We reserve the right to change our fees at any time, with notice provided through the App or our official communication channels. All fees are non-refundable unless otherwise required by law.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Bitfun and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Bitfun.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Bitfun, its affiliates, directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

1. Your access to or use of or inability to access or use the Service;
2. Any conduct or content of any third party on the Service, including exchange outages;
3. Any content obtained from the Service; and
4. Unauthorized access, use, or alteration of your transmissions or content.

9. Indemnification

You agree to defend, indemnify, and hold harmless Bitfun and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or a breach of these Terms.

10. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Bitfun is incorporated, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
